1. Acceptance of Terms

By accessing or using the MyForms24/7 website, applications, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Services

MyForms24/7 provides customizable form templates, document generation, digital products, peer evaluations, and electronic signature features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

3. User Accounts

To access certain features you must create an account. You agree to: (a) provide accurate, current, and complete registration information; (b) maintain the security of your password; (c) accept responsibility for all activity under your account; and (d) notify us immediately of any unauthorized use.

We may suspend or terminate your account if we reasonably believe you have violated these Terms or if your account has been inactive for an extended period.

4. Subscription Plans & Payments

Certain features require a paid subscription. By selecting a plan, you authorize us to charge the applicable fees to your payment method through our payment processor, Stripe. All fees are stated in U.S. dollars unless otherwise noted.

Subscriptions renew automatically at the end of each billing cycle unless canceled beforehand.
You may cancel or change your plan at any time from your account dashboard. Cancellations take effect at the end of the current billing period.
We do not store credit card numbers on our servers; all payment data is handled by Stripe in accordance with PCI-DSS standards.

5. Refund Policy

Digital products and form templates are delivered immediately upon purchase. We offer refunds on a case-by-case basis within 30 days of purchase. To request a refund, contact us at [email protected]. Subscription fees for partially-used billing periods are not refundable.

6. Electronic Signatures

MyForms24/7 is not a dedicated electronic signature platform (such as DocuSign, Adobe Sign, or similar services), nor do we claim compliance with specialized e-signature certifications or standards required of such platforms.

That said, our Service includes electronic signature features designed to be effective and practical for everyday business use. These features include:

Signature capture and embedding — Signers draw or type their signature, which is permanently embedded into the signed document.
Timestamped audit trails — Every signing event (sent, viewed, signed) is recorded with date, time, IP address, and browser information.
Audit certificates — A separate Certificate of Completion is generated for each signed document, documenting the full chain of custody.
Signer identity verification — Documents are sent to a specific email address, and the signer’s name, email, IP address, and user agent are captured at the time of signing.
Document integrity protection — Signed documents are secured with edit and copy restrictions to deter unauthorized alteration.
Secure delivery — Signed documents and audit records are delivered securely and are available for download by authorized parties.

By using the e-signature feature, you consent to conducting business electronically and acknowledge that electronic signatures processed through the Service are intended to satisfy the requirements of the U.S. Electronic Signatures in Global and National Commerce (ESIGN) Act and applicable state Uniform Electronic Transactions Act (UETA) laws. However, MyForms24/7 makes no guarantee of legal enforceability in any specific jurisdiction or for any specific use case. Users are responsible for determining whether electronic signatures are appropriate and legally sufficient for their particular needs.

Document retention: Signed documents, audit certificates, and associated e-signature records are retained for thirty (30) days from the date of creation, after which they are automatically and permanently purged from our systems. This limited retention period is by design to minimize exposure in the event of a data breach. Users are strongly encouraged to download and save their signed documents within this 30-day window. MyForms24/7 does not offer long-term document storage.

7. Intellectual Property

All content, branding, software, and materials provided through the Service are owned by MyForms24/7 or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

You retain ownership of the data and content you create or upload through the Service. By uploading content, you grant us a limited license to store, process, and display it as necessary to provide the Service.

8. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws.
Upload or transmit viruses, malware, or other harmful code.
Attempt to gain unauthorized access to our systems or other users’ accounts.
Interfere with or disrupt the Service or servers connected to the Service.
Scrape, harvest, or collect data from the Service without our written consent.

9. Cookies & Tracking Technologies

The Service uses strictly necessary cookies to maintain your session and security (e.g., authentication tokens, CSRF protection). We also store your cookie-consent preference locally on your device.

10. Data Processing & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

11. Electronic Communications Consent

By creating an account, you consent to receive electronic communications from us, including account notifications, security alerts, service updates, and transaction confirmations. You may opt out of non-essential communications at any time through your account settings or by contacting us.

12. Third-Party Services

The Service integrates with third-party providers (such as Stripe for payments and AWS for hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

13. Service Availability & Downtime

MyForms24/7 strives to maintain continuous availability of the Service; however, we do not guarantee uninterrupted, timely, or error-free access. The Service may be temporarily unavailable due to, but not limited to:

Scheduled or unscheduled server maintenance, updates, or upgrades.
Internet service disruptions, network outages, or telecommunications failures beyond our control.
Third-party hosting provider outages or infrastructure failures.
Distributed denial-of-service (DDoS) attacks or other security incidents.
Force majeure events, including but not limited to natural disasters, power outages, governmental actions, or other circumstances beyond our reasonable control.

MyForms24/7 shall not be held responsible or liable for any loss, damage, or inconvenience caused by the inability to access or use the Service due to internet unavailability, server issues, hosting provider failures, or any other circumstances beyond our reasonable control. This includes, without limitation, any loss of data, missed deadlines, business interruption, or inability to access stored documents or forms during periods of downtime.

We recommend that users maintain their own backup copies of any critical documents, forms, or data submitted through the Service. While we make commercially reasonable efforts to ensure data integrity and availability, we cannot guarantee against data loss resulting from technical failures or events beyond our control.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYFORMS24/7 DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, MyForms24/7 does not warrant or represent that:

The Service will be uninterrupted, timely, secure, or error-free.
The results obtained from the Service will be accurate, reliable, or complete.
Any forms, documents, calculations, or other content generated by the Service are free of errors or suitable for any particular legal, tax, financial, or regulatory purpose.
Any defects in the Service will be corrected within any specific timeframe.

You acknowledge that the forms, calculators, and tools provided through the Service are intended for general informational and operational purposes only and do not constitute legal, tax, financial, or professional advice. You are solely responsible for reviewing and verifying the accuracy and suitability of any output generated by the Service before relying on it.

Your use of the Service is at your sole risk. You assume full responsibility for any decisions made or actions taken based on information or materials obtained through the Service.

15. Limitation of Liability

To the maximum extent permitted by applicable law, MyForms24/7 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total cumulative liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless MyForms24/7 from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

17. Governing Law, Dispute Resolution & Class Action Waiver

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict-of-law provisions.

Any disputes arising under or in connection with these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails within thirty (30) days of written notice of the dispute, either party may submit the dispute to final and binding arbitration administered in Colorado Springs, Colorado, in accordance with the Consumer Arbitration Rules of the American Arbitration Association (“AAA”). The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction.

CLASS ACTION WAIVER: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MYFORMS24/7 EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING WITH RESPECT TO ANY DISPUTE ARISING UNDER OR IN CONNECTION WITH THESE TERMS OR THE SERVICE. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial.

If any portion of this arbitration provision or class action waiver is found to be unenforceable, the remainder of this section shall continue to apply to the fullest extent permitted by law.

18. Time Limit for Claims

To the fullest extent permitted by applicable law, any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after the claim or cause of action arose. If not filed within this period, the claim is permanently barred. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

19. Data Retention & Account Deletion

We retain your account data, form submissions, documents, and associated records for as long as your account is active or as needed to provide the Service. Specific retention periods include:

E-signature records and signed documents: Automatically purged thirty (30) days after creation. Users must download and retain their own copies within this window.
Form submissions and documents: Retained for the duration of your account plus ninety (90) days after closure.
Payment records: Retained as required by tax and financial regulations (typically seven years).

Account deletion: You may request deletion of your account and associated data by contacting us at [email protected]. Upon receiving a verified deletion request, we will delete or de-identify your personal data within thirty (30) days, except where retention is required by law or for legitimate business purposes (such as fraud prevention, legal compliance, or resolving disputes). We will confirm completion of the deletion request via email.

If you are an employer account holder, deletion of your account will also remove access for any team members you have added. Employee form submissions may be retained separately if required by your organization’s compliance obligations.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and MyForms24/7 regarding your use of the Service. These Terms supersede all prior and contemporaneous agreements, proposals, representations, warranties, and understandings — whether written, oral, or electronic — between you and MyForms24/7 relating to the subject matter hereof.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
